Resumo

Resumo: O presente ensaio versa acerca de uma breve reflexão acerca da argumentação jurídica e o crime de desacato, baseada nos ensinamentos do Professor Doutor Manuel Atienza, Catedrático da Universidade de Alicante (Espanha). Inicia-se a breve reflexão, destacando aspectos relacionados a percepção de Estado, bem como da Segurança Pública, transpassando pela gestão pública, através da administração pública, alicerçada seu desenvolvimento nos regulamentos e legislação vigente, passando posteriormente aos crimes contra a administração pública, com enfoque específico ao crime de desacato, tendo como desfecho a argumentação jurídica na motivação das decisões judiciais.

THE LEGAL ARGUMENTS IN THE DECLARATION OF THE CRIME OF DISACTION

Abstract: This essay focuses on a brief reflection on the legal arguments and the contempt of crime, based on the teachings of Professor Manuel Atienza, Professor of the University of Alicante (Spain). Begins the brief reflection, highlighting aspects of the perception of State and Public Security, running through the public management by government, supported its development regulations and legislation, later going to the crimes against the public administration, with specific approach to contempt of crime, with the outcome of the legal arguments in the motivation of judicial decisions.
