A EFETIVIDADE DO PRINCÍPIO DA IGUALDADE FACE À LEI DE COTAS PARA INGRESSO DE NEGROS EM UNIVERSIDADES PÚBLICAS

Resumo

O presente artigo se presta a analisar como se dá a aplicação do princípio da igualdade para ingresso em universidades públicas, na lei de cotas raciais. A Constituição da República Federativa do Brasil assegura tratamento igualitário a todos os cidadãos, sem distinção de qualquer natureza. Em virtude da realidade política e social brasileira se buscou dar mais efetividade ao princípio da igualdade, inserindo no contexto educacional a política de cotas. O sistema foi criado com o escopo de assegurar que estudantes negros tenham acesso ao ensino superior, reservando uma parcela das vagas a esse público. As justificativas para a implantação dessa política afirmativa são a reparação histórica e a inclusão social. No entanto, verifica-se que apesar de bem intencionada, a reserva de vagas para estudantes negros fere o princípio constitucional da igualdade, já que confere direitos a estes em detrimento de milhões de estudantes brancos que também enfrentam exclusão social.

THE EFFECTIVENESS OF THE PRINCIPLE OF EQUALITY FACING THE LAW OF QUOTAS FOR BLACK ENTRY IN PUBLIC UNIVERSITIES

Abstract: This course conclusion work lends itself to examine how it gives the application of the constitutional principle of equality in the law that gives quotas for black students enrolling in public universities. The Constitution of the Federative Republic of Brazil shall ensure equal treatment to all citizens, without distinction of any kind. Similarly, gives the State the obligation to ensure access to all levels of education, according to the capacity of each (art. 208). Thus, by virtue of political reality and Brazilian social is that it tried to give more effectiveness to the principle of equality, entering the educational context the quota policy. The system was created with the aim of ensuring that black students have access to higher education, reserving a portion of the openings to the public. The justifications for the implementation of this policy statement are the historical reparation and social inclusion.
