PEC Nº 471/05: A EFETIVAÇÃO DOS RESPONSÁVEIS E SUBSTITUTOS QUE ASSUMIRAM CARTÓRIOS SEM CONCURSO PÚBLICO APÓS A CONSTITUIÇÃO DE 1988 E AS EXIGÊNCIAS PARA O INGRESSO NA ATIVIDADE NOTARIAL E REGISTRAL

Resumo

Este artigo apresenta uma análise da viabilidade de aplicabilidade constitucional da Proposta de Emenda Constitucional Nº 471/05, juntamente com a verificação dos requisitos para ingresso na atividade notarial e registral. Para análise do proposto, será realizado um estudo da Administração Pública como um todo, além da análise dos dispositivos da Constituição Federal, da lei regulamentar e de outras legislações que dizem respeito ao assunto, bem como a verificação de julgados sobre o tema. Chegando à verificação de que o presente Projeto de Emenda Constitucional vem a ferir alguns dos princípios básicos da Administração Pública, sendo o maior deles, o do Concurso Público, bem como a não observância à dispositivos constitucionais, sendo pouco provável sua implantação no regramento jurídico brasileiro.

Abstract: This article presents an analysis of the feasibility of constitutional applicability of Constitutional Amendment Proposal No. 471/05, together with the verification of the requirements for entry into the notarial and registry activity. For analysis of the proposal, a study of the Public Administration as a whole will be carried out, as well as the analysis of the provisions of the Federal Constitution, of the regulatory law and of other legislation that pertain to the subject, as well as the verification of judgments on the subject. Arriving at the verification that this Draft Constitutional Amendment comes to violate some of the basic principles of Public Administration, the largest being the Public Tender, as well as non-compliance with constitutional provisions, and it is unlikely to be implemented in the Brazilian legal framework.
