Muita discussão será percebida no decorrer deste estudo, que se vê pacificada, neste momento, através das Ações Declaratórias de Constitucionalidade 43, 44 e 54; contudo, é necessário ficar atento a possíveis abusos. É latente a possibilidade de adoção de entendimento mais gravoso, o que deve ser terminantemente proibido para a correta observância constitucional. Para fins metodológicos, esta pesquisa pode ser classificada como de natureza básica, abordagem qualitativa, objetivo exploratório e bibliográfico do tipo narrativo.</p><p><strong>PALAVRAS CHAVE:</strong> Constituição Federal; Presunção de inocência; Prisão em segunda instância; Ações Declaratórias de Constitucionalidade.</p><p><strong>ABSTRACT</strong></p><p>Presenting the results obtained with the project sponsored by the Research Support Fund – RSF, of Universidade Alto Vale do Rio do Peixe – UNIARP, the present research analyzes a topic of fundamental importance, which is the right to the presumption of innocence that is constitutionally guaranteed against the jurisdiction to the contrary based on sentencing decisions in the second judgment, which is done considering the Federal Constitution as the master column that supports all state jurisdiction. Much discussion will be perceived in the course of this study, which is now pacified through Declaratory Actions of Constitutionality 43, 44 and 54; however, it is necessary to be aware of possible abuses. The possibility of adopting a more serious understanding is latent, which should be strictly prohibited for correct constitutional observance. For methodological purposes, this research can be classified as basic in nature, qualitative approach, exploratory and bibliographic objective of the narrative type.</p><p><strong>Keywords</strong>: Federal Constitution; Presumption of innocence; Second instance arrest; Declaratory Actions of Constitutionality.</p> ER -
