SUPREMO TRIBUNAL FEDERAL EM PROCESSO DE MIDIATIZAÇÃO: A BUSCA PELA FELICIDADE COMO ELEMENTO JUSTIFICADOR DE DECISÕES

Resumo

midiatização da vida e sociedade do espetáculo são expressões utilizadas para explicar e compreender as relações contemporâneas. Somando-se a tal perspectiva, percebem-se cada vez mais práticas sociais
conectadas ao consumo. Ocorre que os sujeitos passaram a consumir
até mesmo a informação, e, consequentemente, consomem notícias e
mensagens mediadas acerca dos fenômenos jurídicos. Até mesmo o Supremo Tribunal Federal (STF) tem sofrido um processo de midiatização
constante, buscando maior transparência nas deliberações e interpreta
ções constitucionais. Porém, no decorrer deste processo, é inegável o
sistema cíclico de representações. Questiona-se, portanto, em decisões
recentes do STF - utilizando como elemento justificador argumentos
da busca pela felicidade -, como tal representação é construída por este
tribunal supremo, isto é, que felicidade é esta capaz de garantir constitucionalidade para determinadas condutas dos atores sociais? O artigo
apresentará uma análise acerca da midiatização do Direito, especialmente do STF; demonstrará os casos em que este tribunal utilizou o elemento “felicidade” como justificador da decisão e qual o sentido dado
para esta “busca pela felicidade” pelo STF. A metodologia utilizada tomou por base a coleta bibliográfica-interdisciplinar de dados, buscando
analisar o tema sob um viés integralista, através de uma abordagem
dedutiva.

Supreme Federal Court in a mediatization process:
the pursuit of happiness as a justifying element reason for decisions

ABSTRACT
Mediatization of life and the society of spectacle/entertainment are
expressions used to explain and understand contemporary human
interactions. Added to that perspective, many other social practices
are connected to consumption. People are consuming information and
as a consequence of that, they consume news and mediated messages
even related to juridical phenomena. Also the Supreme Federal Court
(STF) has gone through a mediatization process, trying to show more
transparency of the deliberations and constitutional interpretations. But
during this process it is clear the cyclical system of representations. The
problem of research then is, analysing recent decisions of STF – using
the pursuit of happiness as an element to justify the decisions –, how
representation is built by this supreme court, what kind of happiness that
is, able to guarantee the constitutionality of actions from social actors.
This essay shows the analysis about mediatization of Law, especially in
the Supreme Federal Court, showing cases decided by this court using
the element of “happiness” as a justification for the decision and the
meaning given for such “pursuit for happiness”. Methodology used
takes interdisciplinary data as a base for debate, aiming at analysing the
subject in a total view through deductive studies.
