O DIREITO FUNDAMENTAL À ÁGUA POTÁVEL COMO PRESSUPOSTO DA DIGNIDADE DA PESSOA HUMANA

Resumo

A presente pesquisa teve como objeto a análise do direito a água potável como um direito fundamental, vislumbrando-se o princípio da dignidade da pessoa humana como norteador desta premissa. Para tanto, dividiu-se a pesquisa em três momentos: no primeiro, realizou-se uma pesquisa acerca da evolução da legislação internacional das águas, bem como a contextualização da legislação  referente ao tema que existente no ordenamento jurídico brasileiro. Por conseguinte, passou-se a analisar o caráter de fundamentalidade da água, identificando-se sua finitude e as preocupações do cenário atual ante à sua escassez. Por fim, analisou-se o direito a água potável como premissa de dignidade da pessoa humana. O problema da pesquisa consiste em verificar se o direito a água potável pode ser considerado um direito fundamental. Com relação à metodologia empregada no desenvolvimento do presente trabalho, adotou-se o método indutivo de pesquisa por meio da pesquisa bibliográfica.

THE FUNDAMENTAL RIGHT TO DRINKING WATER AS AN ASSUMPTION OF THE DIGNITY OF THE HUMAN PERSON

Abstract: The present research had as its object the analysis of the right to drinking water as a fundamental right, glimpsing the principle of the dignity of the human person as guiding this premise. For this, the research was divided into three moments: in the first, a research was carried out on the evolution of international water legislation, as well as the contextualization of the legislation related to the subject that exists in the Brazilian legal order. Consequently, we began to analyze the fundamental nature of water, identifying its finitude and the concerns of the current scenario before its scarcity. Finally, the right to drinking water was analyzed as a premise of the dignity of the human person. The research problem is whether the right to clean water can be considered a fundamental right. Regarding the methodology used in the development of the present study, the inductive method of research was adopted through bibliographic research.
