INSTITUTO DA ARBITRAGEM E O ACESSO À JUSTIÇA

Resumo

Procurou-se demonstrar por meio da presente monografia, as características do Instituto da Arbitragem, como forma de demonstrar do que se trata tal Instituto, de onde ele surgiu, onde foi e é utilizado. Ainda demonstrar como tal instituo acabou por se inserir na legislação pátria, as etapas de seu desenvolvimento, os altos e baixos em sua utilização ao longo da história da nossa nação. Para finalmente marcar o ponto onde a Arbitragem se firmou como meio eficaz e eficiente de acesso à justiça, como forma de resolução de conflitos, alternativamente e complementarmente em relação a jurisdição estatal. Culminando nos mecanismos arbitrais que possibilitam a segurança jurídica e sua plena utilização. Mecanismos esses que sofreram recente atualização com a promulgação da Lei 13.105 e da Lei 13.129.

Abstract: The purpose of this monograph was to demonstrate the characteristics of the Arbitration Institute as a way of demonstrating what the Institute is about, where it came from, where it was and is used. Still demonstrate how such an institution ended up being inserted in the homeland legislation, the stages of its development, the ups and downs in its use throughout the history of our nation. To finally mark the point where Arbitration has established itself as an effective and efficient means of access to justice, as a form of conflict resolution, alternatively and complementarily in relation to state jurisdiction. Culminating in the arbitration mechanisms that make legal security and its full use possible. These mechanisms have recently been updated with the enactment of Law 13.105 and the law 13.129.
